A WORKING DRAFT

Work in
good cadence.

These terms explain the basic rules for using Cadence to plan, publish, and manage social content with your team.

YOUR CONTENTYOUR CHOICE
01START HERE

A few clear
expectations.

01

You control what you publish

You choose what to connect, schedule, and send to a social platform.

02

You own your content

You keep your rights; Cadence gets permission to handle it to provide the service.

03

Platforms affect delivery

Social platforms can change access or experience outages, so publishing cannot be guaranteed.

01THE AGREEMENT

Using Cadence

These terms apply when you access or use Cadence, including its web app, APIs, and connected publishing and management features. “Cadence,” “we,” and “us” refer to the service operated by Figmenta. By using Cadence, you agree to these terms. If you use it for a company or another organization, you confirm that you can accept these terms for that organization; “you” then includes that organization.

Cadence provides tools for teams to prepare and schedule social content, connect social accounts, publish posts, review analytics, manage Instagram comments and messages, and use related features. Features can vary by plan, account type, platform permissions, and availability.

02ACCESS & TEAM RESPONSIBILITIES

Accounts & workspaces

  • Give accurate account information, keep your sign-in credentials secure, and tell us if you suspect unauthorized access.
  • Only invite people who should access your workspace. Workspace and organization owners manage membership, roles, and the connected accounts available to their teams.
  • You are responsible for activity under your account and for ensuring team members follow these terms.
  • Connect only social accounts that you own or are authorized to manage. You are responsible for keeping the required platform permissions in place.
03CONTENT & RIGHTS

Your content

You keep ownership

You keep the rights you already have in your captions, media, brand assets, and other material you add to Cadence (“your content”). You are responsible for having the rights and permissions needed to store, edit, and publish that content, including permission from people shown or quoted in it when required.

Permission to operate the service

You give Figmenta permission to host, store, reproduce, format, transmit, and otherwise process your content only as needed to provide, secure, and support the Cadence features you use. This includes sending content to a social platform when you direct Cadence to publish it. This permission ends when the relevant content is deleted from the service, subject to temporary backup copies and records we may need to retain as described in the Privacy policy.

AI suggestions

If you request an AI caption suggestion, Cadence processes the prompt and context you provide to generate it. Suggestions may be inaccurate, incomplete, or similar to material generated for others. Review suggestions and make sure they are appropriate and lawful before you use or publish them.

04THIRD-PARTY SERVICES

Connected platforms

When you connect Instagram, TikTok, or another supported service, you authorize Cadence to use the permissions you approve to provide the features you request. Your use of each platform remains subject to that platform’s own terms and policies. Cadence is not affiliated with or endorsed by Meta or TikTok.

Platforms control their APIs, permissions, account eligibility, publishing rules, and availability. They may change, limit, or withdraw access, reject or remove content, or experience outages. Cadence cannot guarantee that a platform will accept, publish, keep, or display a post, or that every feature will remain available. Check the target account and post status in Cadence and on the platform when timing matters.

You remain responsible for the content you publish and for following the applicable platform rules and laws. Cadence’s compose-time checks are aids; they are not legal advice or a guarantee that content meets a platform’s requirements.

05KEEP THE SERVICE SAFE

Acceptable use

You may not use Cadence to:

  • Break the law, violate another person’s rights, or publish content you are not authorized to use.
  • Send spam, harass people, mislead users, or publish content that violates the rules of a connected platform.
  • Access an account, workspace, or data without authorization, or interfere with another user’s access.
  • Probe, disrupt, overload, reverse engineer, or bypass safeguards, rate limits, or access controls, except where applicable law does not allow that restriction.
  • Use Cadence or connected platform data for advertising, surveillance, or purposes outside the features and permissions you have authorized.
06SERVICE AVAILABILITY

Availability & changes

≥99.5%first-attempt publishing success target

We aim for at least 99.5% successful publishing on the first attempt. This is a target, not a promise that every post will publish or that Cadence will be available without interruption. Network, platform, and service-provider outages happen. Cadence retries some failures; others may need action from you and will be shown in the product where possible.

We may update, add, or remove features as the service develops. We will make reasonable efforts to give notice when a material change significantly affects how you use Cadence.

07DATA & ACCOUNT CONTROLS

Privacy & deletion

Our Privacy policy explains what information Cadence handles, why we use it, and the choices available to you. It applies to our handling of personal information and should be read alongside these terms.

You can disconnect a social account in Cadence or revoke access through the platform. Disconnecting stops future authorized access; it does not necessarily erase content or history already stored in your workspace. To request deletion, follow the steps on our data deletion page. Workspace data is deleted within 30 days after a workspace deletion request, except for information we must retain for legal, security, or backup purposes.

08SUSPENSION & TERMINATION

Ending your use

You can stop using Cadence and ask to close your account or workspace at any time. Either party may end its relationship with the other at any time. We may suspend or restrict access when reasonably necessary to protect the service or its users, address a serious security issue, comply with law, or respond to a violation of these terms. Where appropriate, we will explain the reason and provide a way to resolve it.

After termination, access to Cadence features ends. We handle remaining data as described in the Privacy policy and the deletion section above. Terms that by their nature need to continue, including ownership, outstanding obligations, and legal protections, continue to apply.
